M. Masinda called the Public Hearing to order at 7:40.
ZBA2009-1 Application for variance to Sections 19.07.02.01.01 and 19.07.02.02: 1) to allow for 2 ground signs per lot, 2) to allow for 4 signs on a lot, 3) a 71/2’ line variance on east property line, (RT32), 4) a 6’ line variance on the westerly property line, and 5) a 9’ variance from edge of pavement (RT32), in order to erect an additional 15 ft high maximum, 32 sq ft ground sign at 331 River Road (Map 30 Lot 16 Zone DC Owner/Applicant: CSB Properties (Received April 16, 2009 Public Hearing May 14, 2009 decision within 65 days after close of P.H).
David Stuart was present to speak he stated that he is the owner of property located at 331 River. He said that they would like to put up a sign along Route 32 were one had previously been located.
M. Masinda asked what they had for signs now. D. Stuart stated that they have one free standing sign on Route 74 and 2 wall signs.
Discussion was held on the amount of variance needed and location of the sign.
R. Maloney asked what the hardship is. D. Stuart stated he felt the uniqueness of the building and the two major roads. R. Maloney stated it is Non conforming commercial use.
No one was present to speak either for or against the application.
Public Hearing closed at 8:00

Old Business:
Annemarie Poole made a motion to approve.

B. Semprebon seconded the motion.
Board Members discussed the hardship. The property has a unique topography. The property is a corner lot, abutting on one side by route 32 and one side by route 74.
Original commercial design appeared to have had the sign allowable.
All voted in favor.

A. Poole seconded the motion. All voted in favor.

The Board Members discussed having a notice posted on the Town Web site for alternate members for ZBA
B. Semprebon made a motion to adjourn the meeting. A. Poole seconded the motion. All voted in favor.
